These terms and conditions apply to Elements Carrier website visitors, registered users, or one-time/frequent customers who avail of Elements Carrier services/website for any purpose. We advise you to follow/abide by these terms of use and applicable laws while using its services and accessing the site.

Here the terms ‘we’ or ‘us’ are used for ‘Elements carrier’ itself and ‘you’, visitors, viewers, users, or customers are used for visitors/customers who visit the Elements Carrier website and avail of its services. 

General Information

• We offer Services considering that you are agreeing with these terms and conditions and availing of the services for lawful purposes. At Elements carrier, we may take your booking request through the internet and/or direct call. We may also, at our sole discretion, accept or reject your request for Services.

• If the Company accepts the booking request made by the customer, a confirmation message will be sent to the customer’s mobile number and email address. We will make reasonable efforts to provide services on the specified dates/times and locations.

• Users are advised to take appropriate transit insurance for the goods/product that the users intent to be transporting in order to protect their own interests.

• Elements Carrier will provide all necessary support with regard to insurance claims against damage/theft or any other issues leading to loss of value.

Prohibited Activities

The User must ensure that he/she will not indulge in any of the following activities while availing the Service:

• Damaging the body and/or any other interiors of the mini-truck/tempo/vehicle provided by the Elements Carrier to fulfill the purposes.

• Asking the driver to break any Traffic/RTO/City Police and/or government rules for any purpose. In such cases, the driver has the right to refuse such a request made by the User. The driver also has the right to refuse such a pick-up.

• Pressurizing the driver to overload the vehicle with the consignment than the allowed limit

• Not disclosing the correct contents of goods/materials which are to be sent through the Elements Carrier transport Service

Users Liabilities

• The User must ensure that he/she has made the declaration of goods/materials for the consignment correctly and there is no information which is concealed at the time of booking of the Services.

• The User certifies that all statements and information provided relating to the transportation of the consignment at the time of booking will be true and correct.

• User acknowledges that in the event that user makes an untrue or fraudulent statement about the consignment or any of its contents, the user risks a civil claim and/or criminal prosecution or appropriate penalties.

• User agrees to indemnify the Company if users are found wrong in any disputes made against the Company or he/she lacks fulfilling the requirements agreed at the time of booking. The company ensures to do the same if found guilty for any claims of glitches in providing the services.

Prohibited Goods

Elements Carrier does not allow to carry, nor perform any of its services, on its sole discretion, for the goods which are Prohibited/Hazardous including, but not limited to, those specified in the regulations, guidelines, and technical instructions. Some prohibited goods may be accepted by Elements Carrier, but we may ask to fulfill all the requirements necessary to carry prohibited goods. Prohibited Goods will only be accepted if they comply with the applicable regulations and our requirements.

Rejected Consignments & Holding Charges

In case the receiver refuses to accept delivery, our associates will try to contact the user and agree to the appropriate next action. User must agree to pay the service costs incurred in forwarding, disposing of, or returning the consignment.

The Company will levy holding charges on the consignments that are not collected by the Users/recipients from the point of destination as per the company policy. The rate of holding charges may vary as per company policy.

Payments

Elements Carrier accepts payment through online or offline modes. The User must pay all amounts including but not limited to the fare (as agreed), parking charges, and additional night surcharge (where applicable) and any other fee required for availing of the Services through a secured SSL link or direct contact to our representative.

In case of cancellation of the booking, after making an online payment, the refund of the amount shall be paid within 30 working days counting from the time of cancellation. A small amount of service charge may be levied on such cancellations as per Company Policy.

Limitation of Liability

Though Elements Carrier and its affiliates, under no circumstances, shall be liable for any direct, special, indirect, or consequential damages or any damages whatsoever; including but not limited to loss of use, data, or profits, including but not limited to, negligence arising out of or in connection with the use, copying, or display of the content resulting from access to or use of this Elements Carrier site and its services.

Though the company believes that the entire content is accurate, complete, and current, to the best of its knowledge, yet the Company does not make any warranty about the accuracy, completeness, or currency of the content. Thus, it remains users’ responsibility to verify any information before relying on it.

Law & Jurisdiction

You must be agreeing to resolve the claims of disputes made against the company with the Elements Carrier’s arbitrator first. If disputes are somehow not resolved by arbitrators, you accept that any claims made against the Elements Carrier shall be subject to the jurisdiction of the Canada Court. Also, Elements Carrier reserves the right to take legal proceedings in any state of Canada to protect our interests or to enforce our rights whenever we face any circumstance which deems it appropriate to do so.
